With reference to Article 20 (Privileges and Immunities) (5) and (6), the Kingdom of Belgium declares that, in the event that the EU-LAC International Foundation opens an office in Belgium, it will not grant an exemption from taxes on the salaries and emoluments of staff paid by the Foundation.

The Federal Republic of Germany would like to draw attention to the fact that no taxation privileges above and beyond those set out in Article 20(5) and (6) of the Agreement establishing the EU-LAC International Foundation can be granted in the Headquarters Agreement to be concluded pursuant to Article 20(2) of the Agreement.

In accordance with Article 21 of the Agreement 'Languages of the Foundation', France recalls that French is one of the working languages used in the framework of the strategic partnership between Latin America and the Caribbean and the European Union and that it will use this language in the context of the work and activities of the EU-LAC International Foundation.

[…] the Italian Republic made the following Declarations/Reservations in respect of Article 20(4) and Article 21 of the Agreement:
In the event that the EU-LAC International Foundation should stipulate with the Italian Government a specific Headquarters Agreement containing provisions related to privileges and immunities, pursuant to Art. 20, para.4 of the founding Agreement, the Italian Government will retain the option of limiting tax exemption on salaries and emoluments paid by the Foundation to that staff who is not resident in Italy and does not have Italian citizenship;
2. With regard to Article 21 of the Agreement, Italy recalls that Italian is one of the official languages of the Union. Hence, Italy reserves the right, whether appropriate, to make use of Italian in the context of the work and the activities of the EU-LAC International Foundation. The practices developed within the Organization do not constitute any precedent and do not constrain any future choice.

Peru

In accordance with Article 29 of the Agreement establishing the EU-LAC International Foundation, the Republic of Peru declares that, in order to implement the provisions of Article 20(5) concerning the exemption from direct taxes for the Foundation, its assets, revenues and other property, in the framework of its official activities in Peruvian territory a specific agreement must be concluded between the EU-LAC International Foundation and the Republic of Peru. That agreement will be concluded in accordance with Article 20(4) of the abovementioned constituent agreement.

Portugal

Portugal hereby declares that Portuguese, as one of the languages used by the strategic partnership between the European Union and Latin America and the Caribbean, shall be one of the working languages of the Foundation, in accordance with the provisions of Article 21 of the Agreement establishing the EU-LAC International Foundation.
