Upon signature without reservation of approval of the International Agreement on the use of INMARSAT ship earth stations within the territorial sea and ports, done at London on 16 October 1985 during the fourth session of the Assembly of Parties of INMARSAT, the Government of the French Republic declares that it has the intention, within the strict compliance with the provisions of the articles 3 and 4 of the said Agreement, to restrict the exploitations of the INMARSAT system within its ports and territorial waters, each time circumstances would require to do so.

The Ambassador of Israel to the United Kingdom of Great Britain presents his compliments to the Director General of the International Maritime Satellite Organization and has the honour to refer to the Director General's Verbal Note dated 17 May 1989 informing, inter alia, that Kuwait deposited on 11 May 1989 its Instrument of Ratification of the International Agreement on the Use of INMARSAT Ship Earth Stations within the Territorial Sea and Ports done at Londen on 16 October 1985.
The Government of the State of Israel has noted that Kuwait's Instrument of Ratification was accompanied by a Statement of Understanding in respect of Israel. In the view of the Government of the State of Israel, such statement which is explicitly of a political character is incompatible with the purposes and objectives of this Agreement and cannot, in any way, affect whatever obligations are binding upon Kuwait under general international law or under particular Agreements.
The Government of the State of Israel will, in so far as concerns the substance of the matter, adopt towards the State of Kuwait an attitude of complete reciprocity.

It is understood that the Ratification of the Sate of Kuwait of the International Agreement on the Use of INMARSAT Ship Earth Stations within the Territorial Sea and Ports does not mean in any way a recognition of Israel by the Government of the State of Kuwait. Furthermore, no treaty relations will arise between the State of Kuwait and Israel.
